    Kebbles seek concourt hearing

    Johannesburg - Father and son mining magnates Brett and Roger Kebble will appeal to the Constitutional Court after the Supreme Court of Appeal struck from the roll their application on seven share price manipulation charges. The Kebbles' lawyer, Sharon Wapnick, said on Thursday her clients argued that some of the charges they faced were civil, not criminal offences.


    "The primary question before the court was whether the SCA had juristiction to hear an appeal... before the commencement of the trial."


    She said they would appeal to the Constitutional Court to rule on whether their civil rights would be infringed by having to endure a lengthy trial based on what may prove to be invalid charges.


    Meanwhile the registrar of the SCA said in a statement that as a general rule piecemeal appeals were not permitted.


    This was because it was usually in the interests of justice for a trial to run its course.


    "An appeal before the end of the trial could cause delays, and among other things, turn out to have been unnecessary if the charges were eventually to fail for other reasons."


    According to the SCA, six of the seven counts against which the Kebbles as well as JCI director Hendrik Buitendag wanted to appeal alleged fraud, with various alternative charges.


    They face 13 charges altogether.
    The seventh count was one of insider trading in contravention of the Insider Trading Act of 1998.


    "All the counts in some way concern a series of share-dealings between October 1999 and January 2000, the purpose of which was to restructure the group of companies known as the JCI-Randgold Group," read the statement.


    "At the time, according to the indictment, Western Areas was one of seven companies in the group and Brett Kebble was the company's chief executive officer.


    "Hendrik Buitendag was a director of JCI Gold, another company in the group and Roger Kebble was executive chairman of Durban Roodepoort Deep.


    "Essential to the restructuring was acquisition of all the shares in Randfontein Estates, a third company in the group."


    According to the prosecution, the four decided to acquire the Randfontein shares through a scheme of arrangement in terms of the Companies Act.


    "To succeed, the scheme needed a 75% 'yes' vote at a Randfontein shareholders meeting," read the SCA statement.


    "The state case is that the offences charged, and certain related breaches of the Companies Act and rules of the Securities Regulation Panel established under the Companies Act, were committed by the accused, acting in concert, in an attempt to acquire the number of Randfontein shares necessary to achieve that vote.


    "The fraud counts allege that the accused failed to disclose facts which they were under a duty by statute and at common law to disclose."

    Zu dem "Erdbeben" möchte ich mal was sagen.



    In Südafrika gibt es keine Erdbeben


    (durchgehende Erdplatte ohne vulkanische Aktivität).

    Es beklagt der CEO von DRD, daß bei Grades von


    15 g/t nur eine Ausbeute von 5 g/t erzielt wird.


    Die Hauer sind ja nicht blöd. Die wissen, daß sie


    so oder so gefeuert werden. Da gehen die lieber an einer


    sicheren Stelle 2 km untertage mit dem Preßlufthammer an taubes Gestein.


    Lest mal das letzte Brett Kebble Interview unter diesem Gesichtspunkt.


    Der redet schon fast Klartext.




    Versteht mich nicht falsch, als wollte ich miese Stimmung machen.


    Ich halte einen für meine Verhältnisse ordentlichen Depotanteil DRD


    und je genausoviel Harmony und Goldfields.



    Mich stört nur die -entschuldigt Schweinchen Schlau Logik-


    vom Lottogewinn mit fingiertem Konkurs, der das Pflichtenheft


    gelöscht haben soll.

    die Reaktion mit einem Kraftwort auf meinen Text gefiel mir sogar.


    Ich hatte den Text spontan und schnell geschrieben.

    Für mich der Sinn von Postings.


    Bei längerem Nachdenken, wär´ich vielleicht sogar darauf


    gekommen, daß er sich auf den Schlips getreten fühlen könnte.

    Soweit zum Formalen.



    Inhaltlich ordnet sich das Knäuel


    im RSA - Minendesaster allmählich zu


    einzelnen Alternativen. Das ist für mich mühsam


    und geht nur Schritt für Schritt.


    Wer da was drüber denkt juckt mich nicht.


    Würd ich das für mich privat auf Zetteln machen,


    wäre die Anspannung und die Eigenkontrolle geringer.

    wofür die Kebbles jetzt 7x bestraft werden sollen war

    der Anfang der Entflechtung von JCI.

    Da kann man nur den gordischen Knoten durchschlagen

    oder alles laufen lassen wie bisher.


    Es sit mein Fluch, die Kebbles immer zu verteidigen.

    Aber immerhin hab´ich damals Gratis-Aktien von WAR


    bekommen (wie alle anderen WAR-Aktionäre ebenfalls).

    Was die kebble's machen oder nicht ist mir egal da ich fast keine kohle bei denen angelegt habe. Sicher hast du recht mit deiner entflechtung von JCI/DRD aber sie sind von haus auf nicht kosher ! :D
    Die sind mafiosi und die meinung habe ich ueber sie, und behalte sie auch. Das ist alles !

    Bevor die posaunen von jericho erklingen spricht sich das laengst vorher in den synagogen um, wo hauptsaechlich business besprochen wird.
    Die halten zusammen und spielen sich erst gegenseitig die baelle zu.
    Die haben einen sogenannten code of conduct, den wir leider nicht haben. Den letzten beissen dann die hunde X(, aber die meisten von denen habe die posaunen vorher gehoert. Zum groessten teil ist die ganze wirtschaft hier in ihren haenden und die meisten sind landlords die gut dabei verdienen...... Just watch out, buddy ! ;)

    DRDGold must pay for pumping - AngloGold

    AngloGold Ashanti has approached the court to force DRDGold to pay pumping charges to keep two closed mines from filling with water and flooding its own nearby shafts, knocking out a fifth of its production and causing damage to assets worth R11.8 billion.


    DRDGold liquidated its North West operations on March 22, firing 6 000 workers. It says it is not liable for the charges, which AngloGold puts at R85 million a year. AngloGold says DRDGold is required by law to keep paying.


    In papers filed in the high court on Monday, AngloGold applied for an urgent order forcing DRDGold to continue paying the pumping costs.


    AngloGold said court-appointed liquidators had told its representatives at an April 6 meeting that the pumps would stop yesterday unless they received payment from DRDGold, AngloGold and Harmony Gold Mining, all of which have mines in the area.


    "Since none of these parties have given any undertakings to do this, there is an imminent danger beyond Tuesday that pumping will cease, with the calamitous consequences detailed in this affidavit," AngloGold said in the papers.


    "If urgent relief is not obtained, then AngloGold's most valuable mining asset in South Africa will be lost. The estimated value of destruction is R11.8 billion."


    Deep mines in South Africa are sunk through water-bearing rock, and flood once pumping stops, as do neighbouring mines, linked together by a labyrinth of tunnels and passageways.


    Harmony and Placer Dome are in a similar dispute over Harmony's intention to flood its loss-making Randfontein Four Shaft, which adjoins Placer's 50 percent-owned South Deep mine.


    AngloGold's court action was also directed at the ministers of minerals and energy, water and forestry, and environment and tourism, the company said in court documents.


    It wants the departments to enforce a number of laws which it says prevent DRDGold from absolving itself of responsibility for keeping the mines dry.


    "All we are asking is that people comply with legislation," said Steve Lenahan, an AngloGold spokesperson, in an interview.


    If the pumping stopped, the "inevitable result" would be flooding of AngloGold's Great Noligwa, Moab Khotsong and Kopanang mines, AngloGold said. "Apart from the serious short-term risk to the safety of miners working in these mines, the flooding of the mines would be practically irreversible."


    Kopanang and Great Noligwa together produced 1.28 million ounces of gold last year, more than a third of AngloGold's South African output and more than a fifth of its total production of 6.05 million ounces. Moab Khotsong, a new mine 3km deep, is expected to produce an average of 408 000 ounces a year between 2006 and 2018.


    As many as 12 000 people work at the AngloGold operations.


    "DRD is planning to defend the application," said DRDGold spokesperson James Duncan. "DRD's position is that charges of this sort cannot be delegated to the shareholder."

    Sollte das Pumpen in den Nord-West-Minen tatsächlich

    in irgendeinem Bereich beendet werden, wird

    dies der Anfang vom Ende des Gold-Minig in RSA sein.


    Manche haben ihr Abwandern gut vorbereitet wie Goldfields.

    Andere ganz Große wie Harmony könnten es auch noch schaffen.


    für Durban hieße es aber ALOA Fidschji; wir kommen im Einbaum.

    Deshalb ist es so verwunderlich, daß gerade Durban die lawine lostritt.

    Oder ist das nur Mimkri? Wahrscheinlich ja.
