GO :))
Uhhh !

DRD obligated to pump water: AngloGold Ashanti
=======================================
The legal obligation to continue pumping underground water from the Hartebeesfontein and Buffelfontein gold mines will still rest with DRDGOLD (DRD) after the liquidation the two gold mines, says AngloGold Ashanti (ANG). "AngloGold Ashanti is not willing to assume this liability, the cost of which we estimate at 85 million rand a year," the group said. Four gold mining companies operate in the Klerksdorp-Orkney-Stilfontein-Hartebeestfontein area. The companies are DRDGOLD, Harmony Gold (HAR), Stilfontein Gold Mining and AngloGold Ashanti. All the mines not operated by AngloGold Ashanti are updip of AngloGold Ashanti mines and underground water, if not controlled, would flow down the natural dip in the underground strata into the AngloGold Ashanti gold mines, the group said. "Consequently, the updip mines are obliged in law to continue pumping underground water, even after their mining operations have ceased," AngloGold Ashanti said. The obligation to continue pumping underground water arises under common law as well as the National Water Act 36 of 1998, the National Environmental Management Act 107 of 1998, the Minerals and Petroleum Resources Development Act 28 of 2002 and the Mine Health and Saftey Act 29 of 1996, the group said. Any change to the mine pumping activity, including the end to pumping, would only be permissible if authorised by the relevant licence or the Department of Water Affairs and Forestry, AngloGold Ashanti said. The National Water Act also imposes a relatively stringent duty of care on the upstream mines' use of water and any pollution arising from such water use, the group said. In the event that cessation of pumping upstream causes pollution downstream, the National Water Act obliges the upstream mines to effect reasonable measures to prevent any pollution from continuing, occurring and recurring. Failure to implement such measures empowers the Department of Water Affairs and Forestry to issue a directive to the upstream mine responsible for causing downstream pollution. "Failure to comply with that directive in turn permits the Department of Water Affairs and Forestry to effect the necessary reasonable measures, and to recover the costs from the offending mine," AngloGold Ashanti said. The National Water Act also makes it a criminal offence to unlawfully and intentionally or negligently commit any act or omission, which detrimentally affects or is likely to affect a water resource. The National Environmental Management Act 107 of 1998 also contains a relatively stringent duty of care provisions as far as general pollution is concerned, AngloGold Ashanti said. The Mineral and Petroleum Resources Development Act 28 of 2002 is relevant to the closure of any of the upstream mines. Under the Mineral and Petroleum Resources Development Act a closure certificate may not be issued unless the Chief Inspector and the Department of Water Affairs and Forestry have confirmed in writing that issues pertaining to health and safety as well as management of potential pollution to water resources have been addressed. The Mineral and Petroleum Resources Development also places joint and several liability on the directors of a company for any unacceptable negative impact on the environment, including damage, degradation or pollution advertently or inadvertently caused by the company, which they represent or represented. The Minister of Minerals and Energy also has the power to issue a directive to the holder of a mining right to take the necessary measures to stop pollution of the environment, AngloGold Ashanti said. "If the company fails to comply, the Minister may cause the necessary measures to stop the pollution to be implemented and seek recourse against the offending company or as stipulated under the Mineral and Petroleum Resources Development," the group added. The Mine Health and Safety Act 29 of 1996 is relevant to the issue of actual or potential risks and hazards to the safety of employees as well as third parties. Under the Mine Health and Safety Act every employer must provide and maintain a working environment that is safe and without risk to the health of employees as well as persons who are not employees but who may be directly affected by the activities at the mine. The obligation includes an obligation not to expose such employees or any third parties to any hazards to their health and safety. Under the Mine Health and Safety Act it is also a criminal offence to cause a serious injury or a serious illness to a person other than an employer or an employee by way of negligent act or omission, AngloGold Ashanti said. In terms of the common law, in the event that the updip mines threaten cessation of pumping activities or indeed cease pumping activities, provided AngloGold Ashanti can show that in consequence its property may or in fact does suffer harm, there would be sufficient basis for AngloGold Ashanti to approach a court for an interdict ordering the responsible upstream mines to continue pumping activities.
Also weiter pumpen !
@Sorry

@GO
Tony, his lap dog also coming ??

AngloGold Worried About Possible Mine Flooding
======================================
JOHANNESBURG (Reuters) - South Africa's AngloGold Ashanti Ltd (ANGJ.J: Quote, Profile, Research) said on Wednesday that struggling rival DRDGOLD must still pump water from its shut mines since its own operations nearby were otherwise in danger of flooding.
DRDGOLD (DRDJ.J: Quote, Profile, Research) put into liquidation its North West mines last month, cutting production by a third and putting 6,500 people out of work.
It has argued that court-appointed liquidators were responsible for either finding a buyer for the loss-making operations or closing them down and paying for pumping out around 30 million litres of water per day.
But AngloGold, the world's second biggest gold producer, issued a statement saying it was not willing to pick up the tab for the pumping, estimated to cost 85 million rand ($13.89 million) per year.
"AngloGold Ashanti takes the view that an act of liquidation cannot be utilised to avoid statutory obligations," it said.
A AngloGold spokesman said it had not been informed that pumping was due to be halted at the DRDGOLD's North West mines, but it was concerned about the issue.
"Underground water, if not controlled, would flow down the natural dip in the underground strata into AngloGold Ashanti mines," the statement said, which also cited several laws obliging pumping to continue.
DRDGOLD spokesman Ilja Graulich referred quesions regarding pumping to the liquidators of the North West operations.
AngloGold's mines under threat are Great Noligwa, Kopanang and Moab Khotsong. The first two produced 326,000 ounces of gold in the quarter to end December, a fifth of the group's total output of 1.7 million ounces.
Moab Khotsong is a new mine due to launch commercial production next year.
Shares in AngloGold, majority owned by diversifed miner Anglo American (AAL.L: Quote, Profile, Research) (AGLJ.J: Quote, Profile, Research) , were virtually unchanged at 215 rand at 1305 GMT while DRDGOLD shares fell 5.36 percent to 5.30 rand in very thin volume
