    No end to rates nightmare

Reserve Bank Governor Tito Mboweni's warning that South Africans need to tighten their belts has come home to roost with a fourth consecutive interest rate hike.

Also bloss nicht ja sagen wenn das Thai Girl fragt , do you buy me 5 Baht Gold ? :D

    Foreigners face SA property ban

    2006-12-7 10:59

Cape Town - The South African government is to take its first step to regulate foreign land ownership - particularly along the Cape coastal area - which it says is being increasingly sold off at excessively high prices which only foreigners and "the super rich" can afford.
Fuller detail of the Integrated Coastal Management Bill will be made known on Sunday by Environmental Affairs and Tourism Minister Marthinus van Schalkwyk.

Government spokesperson, Themba Maseko, said on Thursday that cabinet was extremely concerned about "the mushrooming of estates in many parts of the country particularly in the Cape".

Certain sections of land had "basically been closed off and sold off" at a very high price which "only the super rich and foreigners" could afford.

Maseko, reading a written statement on Thursday after Wednesday's cabinet meeting in Pretoria, said cabinet had expressed its concern about the unmitigated sale of coastal land "which has the effect of limiting public access to South Africa's coastline".

He said the minister of environmental affairs and tourism "will announce further details on what steps government could take to arrest this trend".

"Otherwise South Africans could wake up one day and discover that only foreign nationals and the super rich had access to our coastline," said Maseko.

Focus on foreign ownership of land first arose in August 2004 when then Land and Agriculture Minister Thoko Didiza named a nine-person committee to probe the issue of land ownership and land use by foreigners headed by Professor Shadrack Gutto, director of the Centre for African Renaissance Studies.

Earlier this year Gutto in an interim report recommended an immediate moratorium on the sale of land to foreigners.

    1. I find it ironic that judges takes everything nem said on face value. if nem really thought the case was so clear cut, whey did they choose to restructure the contract with AQI, AFTER they learned that IMR staked navidad with BLEG A.
There is testimony that NEM thought IMR used their BLEGA data to find Navidad after IMR reported first drill holes and well before AQI and NEM agreed on the Calcatreu sale.

The only plausiable conclusion was that NEM thought they gave BLEGA away without contingency, and wished that they hadn't. If there is any other way NEM would have sued. Of course Harvey is not gonna say that, or he will be sacked for giving $1 billion away. A 5 year old can figure this out. :D

    2. Use of constructive trust is weak in this case. Given there is no trust flavor in this case. The appeal judge will rule that BLEG A, while proprietary, is of little commercial value, easily duplicable, and treated in a NON-confidential manner to IMR (no importanta, free access). Therefore the judgment does not warrant constructive trust even though BLEGA directly lead to Navidad. Folks, Navidad is NOT THE SAME AS BLEG that LED to Navidad. Much like my sperm is NOT the same as my child. This is stark contrast to Lac-Corona, where

The information shared by Corona with Lac was private, disclosed with JV in mind, highly confidential and directly relevant to the claims which Corona intended to stake

Whether the appeal judge believes the gift theory or not, constructive trust will be overturned in favor of damages.

    ---------------------------------------------------------------

Cuburu noted that Crespo approved “free access to
information by IMA” and that “IMA had some properties in Peru that Newmont from Bruce Harvey showed
    interest.”

So Crespo or Cuburu was disciplined? Is this not the smoking gun, we have the spreadsheet and the testimony of Lhotka "pero Carlos no me
corresponde". IMA clearly thought this information was a gift. "

Huh? Even if this information was accurate, it proves nor suggests nothing. I will take what you and the factum say at face value, namely, that Newmont was interested in IMA's properties. Do this mean or in anyway show that the data was a gift? A quid pro quo for currying favour with IMA on their properties? Huh? Why can't Newmont be interested in the Peru properties and nonetheless give IMA the Bleg A strictly for the purpose of the evaluation? All the factum does is try to show that Newmont wanted to maintain good relations with IMA for some alterior motives (the properties in Peru.) It does not show in the least that the two things are in any way related.

And this is their BEST evidence going forward. Concede the facts to IMA and they still don't have a case. It's pathetic.

Of course, there are more facts than this. Before the second site visit, IMA had been denied exclusivity on the bid, which should put the matter of special treatment to rest. As well, EVERYONE - IMA, Newmont and Minera - all admitted that NO ONE gives away data without documentation to govern its use. Moreover, moreover: IMA's post poaching conduct clearly shows that IMA did NOT consider the data a gift, for if they had considered it a gift, they would not have lied about its origins repeatedly. I could go on about the evidence for pages, but will spare you all.

IMA is wasting money on this appeal - they have nothing new to offer above and beyond that that was presented at trial, which turned out to be a bloody thumpfest. Get over it. Joe is doing this to protect his own ass. 8o

    Neue Postings vom Stockhouse:

Why do you say it was obvious *why* IMA asked for the data? Pls cite evidence to this effect."
    -----------

"Bleg A was requested after Lhotka saw a big map was seen with regional data. That's why it's obvious. They didn't need it for the bid, it was an unusual request. A spreadsheet is there as evidence which says the release was on the basis of "free access". Notwithstanding the fact that IMA actually used it!"

Two points: 1) Lhotka did not see the A data; he merely saw the sample points. 2) It was admitted by all parties -- including Lhotka himself -- that seeing exploration data around a known deposit is helpful when evaluating the merit of said deposit. It is entirely reasonable, then, for Cuburu to have assumed that Lhotka wanted to see the data for purposes of evaluation. By contrast, insofar as it is exceedingly rare to allow unrestrictd use of proprietary data without documentation, it would have been a stretch, bizarre even, for Cuburu or anyone else at Minera to have assumed Lhotka wanted the data for his own use.

    ==============================
Do you see? There is nothing in IMA's submissions that support the contention that the data was given for anything but the evaluation. Nothing. And that's their BEST case.

    ----

[...] They knew what IMA wanted the data for. [...] so how could the request possibly be construed any other way?

See above. Obviously seeing the BLEG would have been helpful for evaluation. There was no evidence - NONE! - that indicated Cuburu or anyone else thought they were giving away the rights to a $400k sample program for some kind of vague if-come, from a Vancouver junior, no less. It would have been absolutely bizarre to have assumed this. This never, ever happens in this industry.

    =============================

"what about the Lhotka's evidence that he never gave out data in a manner that would jeopardize his client's property? Or that he told his subordinates that everything they were about to see on site was confidential.
    ----

"Very professional of him. He got some data from newmont and didn't pass it to all and sundry."

No, instead he went out and staked on it, thereby depriving the rightful owner from deriving any benefit from it. Very professional indeed!

(Do you realize you are talking about intellectual property theft? Surely you do, yet so brazen!)

    ==============================

"Forget what Lohtka did, or what he said, or wether he lied, or whether he acted suspicious... did Newmont give him free access or not?"

Sorry to get personal, but you manifest the intellectual agility of a billard ball. Does "free access" mean "free usage"? Of course not. I recommend Q-tips, real long ones.

    =================================

"Ok, then why did Grosso, Lhotka and Patterson lie to IMA's own BOARD? Yes, this is true and uncontested. They were so worried about keeping the true nature of the discovery under wraps that they lied to their own Board."
    -----------
"Whatever happened is an internal matter for IMA. They could have beaten the members of the board with birch branches, dressed from head to toe in PVC... but did Newmont adequately cover themselves... if they did then why not sue IMA directly?"

Sure, then can do what they want. But when asked, on the stand, about WHY they lied to their own Board, it goes straight to their credibility if they can't come up with a good answer. Which is precisely what happened. "Why did you lie to your own Board", asked Minera's lawyers. The IMA rep on the stand, the one who did the lying, just sputtered and could not come up with an answer, let alone a good one. With that one stroke, all IMA's bullsh-t about not wanting to embarass Newmont blew up in their face, in full view of the presiding judge. It was clear to everyone that IMA tried to pull a fast one, then tried to cover it up, tried to conceal how they found the deposit. The ONLY reason they would have done this was if they had thought the data was NOT theirs to use.

You may think otherwise, but then again, you may also be an idiot.

How high silver can go ?

    http://silverstrategies.com/story.aspx?local=1&id=5788

When I recommended silver in 2004, I said that it could rise by 2,785% from the level then existing.
This meant a price of $187.50. I got this by thinking about the gold/silver ratio.

My price target for gold was and still is $3,000 by 2020.
And 3000 is 16 times 187.50. Why did I pick 16? You can see why when you know about the history of the gold/silver ratio.

think we will see this area reached again. Whether it is 14.82, or 15 or 16, I think that silver will continue to rise faster than gold and the ratio will end up, even briefly, back in this traditional area.

So if we take a more conservative 16:1 ratio, and if gold reaches a high of $3,000 during this bull cycle, this means $187.50 silver.

Of course, this is just a guess at this point. Who knows where gold will end up by the time this bull market is over? It could be $4,000, in which case a 16:1 ratio would be $250 silver.

For now, I'm content to watch and wait and see where this bull market will take both metals.

    Mal schaun

COSMIC INFLUENCES - POWERFUL EMOTIONS - & DEC. PLANETARY ALIGNMENTS!

    Posted By: Ladyhawke
    Date: Wednesday, 6 December 2006, 3:19 p.m.

I just came across this article covering Shamanic astrology for the month of December. I hope it will help each of us understand the intensity of the emotions we may be feeling during this time. Yes, things are being stirred up. Most are feeling this in some way! Change is an essential part of this process.

Recently, I posted an article in the RR about how 'very powerful transformational energies are coming in to the planet.' This means all may not be calm and peaceful during this transitional experience. Humans are composed primarily of water. This means emotions (a water element) can be dramatically stirred up during this time of great metamorphisis.

What is being stirred up? Quite possibly ... old programs from the past which no longer serve us. Many of these programs were created to divide us so that lessons could be learned through comparison and contrast. Some believe it is now time to move beyond our lessons of polarity to a higher expression of infinite consciousness. We need to remember at this time there are powerful energies at work in the universe ... directed by the Divine Director of all ... The Creator.

At this time there are extremely strong cosmic energies hitting the planet and every person who resides here. This is the time which the ancient Mayans called the 5th Day. We are also passing through the photon belt (photonic energy field). In addition, the last two days we just passed through a full moon in Gemini which brought forward our shadow side ... we each have one (the other twin). This is simply a time to release those parts of ourselves that no longer serve our highest purpose. This is about being in integrity with ... who we really are.

We also have a powerful and significant planetary alignment coming up in the next few days (Dec. 8-10) so hang on to you knickers ... it isn't over yet!

And, as if that isn't enough, we have the Winter Solstice (Dec. 21rst-22nd) coming up this month that will guarantee a spiritual assessment of whether or not we are in alignment with the intent of our higher self. For all transformation begins within.

There are many windows of opportunity for positive change in this month of December. May we be gentle with ourselves and with each other as we share this sometimes challenging experience together.

LET'S NOT QUIT WHEN WE ARE SO CLOSE TO THE FINISH LINE!

    The Commentary:

“Here is a stunner … the gold open interest fell a whopping 14,403 contracts to 324,353, which is some 50,000 contracts off its high earlier this year and well off its highs of November.

It seems The Gold Cartel’s price-capping antics are stopping out spec longs on the breaks.
Then, as the specs pitch their longs, the cabal forces and physical markets soak them up, which is why the market keeps rebounding. It would be wonderful if we get another big OI drop tomorrow.

From a technical standpoint, this is extremely bullish. The specs which are running for the hills today will return as buyers $10 and $20 higher, after gold breaks solidly through $650.”

War could cost US $1 trillion+

    2006-12-6 20:59

Washington - The Democratic co-chair of the Iraq study group said on Wednesday that America's ability to resolve the crisis in Iraq was narrowing and the costs could rise to more than $1 trillion.

At a news conference to release the bipartisan group's long-awaited report, Lee Hamilton said: "The current approach is not working and the ability of the United States to influence events is diminishing."

"No course of action in Iraq (is) guaranteed to stop a slide toward chaos.

"Yet, in our view, not all options have been exhausted."

Hamilton also said the high-level panel concluded the US costs "could well rise over a $1 trillion".
