    Pretoria - Judgment was reserved on Monday in an urgent Pretoria High Court application by trade union Solidarity to set aside the appointment of liquidators for Buffelsfontein Gold Mines.
    The mine was provisionally liquidated in the Johannesburg High Court last month, and three provisional liquidators were appointed by the Master of the High Court.


    Solidarity, however, claimed the mine's 6 500 workers would not be represented in the liquidation process.


    It contended employees stood to be seriously prejudiced if preference was given to commercial creditors, rather than the workers.


    The union asked the court to set aside the Master of the High Court's decision to not appoint the union's chosen representative, Johannes du Plessis, as joint provisional liquidator and to direct the Master to appoint him.


    Solidarity secretary Andries van der Merwe said in court papers the union represented 268 employees, who had claims of over R21m.


    The union feared insufficient or no note had been taken of the plight of employees in the liquidation process.


    Van der Merwe said liquidators nominated by large commercial creditors were inclined to take decisions that did not secure the continued employment of the workers.


    Workers were mostly innocent victims of the insolvency of their employers. Appointing a liquidator nominated by their trade union reassured employees that their interests would be represented.


    Counsel for Solidarity argued before Judge George Maluleke that workers "were now sitting at home in great uncertainty".


    The Master of the High Court opposed the application, saying the matter was not urgent.


    The first meeting of creditors had not been held yet and the mine was still operating. If any workers were sitting at home, it might be just the 5% represented by Solidarity, the court was told.


    Acting Chief Master John Baloyi said in court papers the appointment of one of the liquidators, Barend Pietersen, in any event enjoyed the support of the largest trade union.


    This body, the National Union of Mineworkers, would represent the interest of all of the workers.


    Judge Maluleke will give judgment at a later date.

  • Wenn ich mir nun alles so anschaue dann habe ich das gefuehl dass erstmal alle RSA GM aktien eine Patanosterfahrt durch den keller machen. Wenn das ding wieder auf dem erdgeschoss ist kann man wieder einsteigen falls man glaubt es geht wirklich wieder aufwaerts.
    Da muss schon jemand auf G oder R druecken, damit es schneller geht. ;)


    Aber wer drueckt schon drauf ???


    Ich bin jedenfalls froh dass ich diversifiziert habe und nicht mit beiden fuessen in Tiefminen RSA stecke und mit denen eine Kellerfahrt machen muss die lange dauern kann.


    Ich habe mich mit den Rand und Tiefminen leicht verbrannt bzw.verkalkuliert, die sind seit Oktober ein reines Fiasko. Da haette ich besser blind irgendwelche explorer genommen als den Afrikaans/Neger Stock. Hinterher ist man immer schlauer.
    Zum Glueck habe ich andere im Depo die den Schaden irgenwie ausgleichen. :))


    Ich trage es mit wuerde und habe wieder gelernt das nicht alles gold ist was glaenzt. .... Eine Wasserspiegelung war es ! :D

    wenn noch viele Marktteilnehmer so denken wie Du, kann es bald wieder aufwärts gehen.


    Die Paternosterfahrt ist bei Droopy schon weit fortgeschritten, schau Dir mal die Tickliste von gestern an, welche Größenordnungen da gehandelt werden: massenhaft zwischen 100 und 2.000 Stück.


    Bei Harmony könnte es noch auf 6 - 6,50 $ gehen, aber dann dürfte auch da der Keller durchfahren sein.

    Resigniert habe ich noch nicht,klar die sind schon bei der kellerfahrt und viel schlimmer kann es wahrscheinlich gar nicht mehr kommen. Die bad news sind alle im preis einkalkuliert.


    Glaube mir ich wuerde mich auch freuen wenn es wieder aufwaerts geht und habe hier nur eine meinung ausgedrueckt was ich z.Zt ueber die RSA minen im allgemeinen halte. Rosig siehst bestimmt nicht aus und hoffe das mein stoploss von 0.80 USD nicht kommt. Ulfur wartet schon mit seinen netz darauf ! :D


    In der zwischenzeit sollte man wo anders geld verdienen und die dinge erstmal laufen lassen, IMHO.


    GFI fliegt raus bei USD 10.40, HMY bei 7 $, und die Droopy bei 0.80 $.


    Pasta ! (auch wenn ich dann zum falschen preis verkauft habe)


    Irgendwo muss ja ein stop loss sein, oder ?

  • AngloGold Ashanti goes to court on DRDGOLD pumping

    JOHANNESBURG (Reuters) - AngloGold Ashanti Ltd said it will ask a court on Tuesday to force South African rival DRDGOLD to keep pumping water from shut mines since otherwise its own mines nearby were in danger of flooding.


    DRDGOLD put into liquidation its North West mines last month, cutting production by a third and putting 6,500 people out of work.


    Threatened by possible flooding are two of the biggest mines owned by AngloGold, the world's second largest gold producer, and a mine owned by Harmony Gold.


    "It's an urgent application which suggests that there is a risk that pumping will not continue and if that happens both ourselves and Harmony will be at some risk," AngloGold spokesman Steve Lenahan said.


    The application is expected to be heard by the Johannesburg High Court later on Tuesday.


    DRDGOLD has argued that court-appointed liquidators were responsible for either finding a buyer for the loss-making North West operations or closing them down and paying for pumping around 30 million litres of water per day.


    But AngloGold said last week it was not willing to pick up the tab for the pumping, estimated to cost 85 million rand per year, because it did not believe that liquidation automatically relieves a firm of all legal obligations.


    AngloGold held talks with both DRDGOLD and the liquidators of their North West mines, Lenahan said.


    "The discussions haven't accomplished a short-term goal for us of giving us the comfort that the various parties are going to comply with their legal obligations," he said.


    The liquidator has asked AngloGold and Harmony to contribute to the pumping costs, which the firm is willing to discuss, Lenahan said.


    "We're very happy to continue with this debate for the longer term, but in the short term what we need is the certainty that the various parties are going to do what they are required to do," he said.


    AngloGold's mines under threat are Great Noligwa, Kopanang and Moab Khotsong. The first two produced 326,000 ounces of gold in the quarter to end December, a fifth of the group's total output of 1.7 million ounces.


    Moab Khotsong is a new mine due to launch commercial production next year.


    Shares in AngloGold, majority owned by diversified miner Anglo American, were virtually unchanged at 214.90 rand at 0845 GMT, DRDGOLD shares fell 1.92 percent to 5.10 rand and Harmony edged down 0.21 percent to 47.40 rand.


    The gold mining index was off 0.14 percent.

    Anglo zieht unser armes Schweinchen Schlau also vor Gericht. Interessant am Artikel ist jedoch, daß nun Anglo durchaus diskussionsbereit erscheint! Früher hieß es, die Wünsche der Liquidatoren nach Kostenbeteiligung wären rundweg abgelehnt worden. Inzwischen ist Anglo "happy" die Sache unter längerfristigen Gesichtspunkten zu diskutieren. Nur kurzfristig will Anglo verhindern, daß die Pumpen abgestellt werden.

    Ich finde, alleine zur Ansicht sollte das Grüngemüse (ausnahmsweise nicht vitaminhaltig :D) dem Forum auf jeden Fall erhalten bleiben.


    Spart ja auch Zeit: man liest nicht mehr so viel, und kümmert sich um andere, sinnvollere Dinge.

    Die Liquidatoren wollten am Dienstag das Abpumpen einstellen, wenn nicht Anglo, DRD oder Harmony das Geld dafür aufbringen.


    Bedeutet das gleichzeitig, daß die Liqidatoren keine Chance für North-West mehr sehen, kein Erwerber in Sicht?


    Über die Gerichtsentscheidung anscheinend noch nichts bekannt.

    [miningmx.com] -- AngloGold Ashanti has asked a South African judge to force DRDGOLD to pay pumping charges to keep two closed mines from filling with water and flooding its own nearby shafts, knocking out a fifth of its production and causing damage to assets worth R11.8 billion, reports Bloomberg.



    According to the news wire's report, papers were filed this morning in South Africa's High Court, applying for an urgent order forcing DRDGOLD to continue paying the pumping costs. AngloGold Ashanti said court-appointed liquidators told the company that the pumps would stop today unless it received payment from DRDGOLD, AngloGold and Harmony Gold, all of which have mines in the area.


    "Since none of these parties have given any undertakings to do this, there is an imminent danger beyond Tuesday that pumping will cease, with the calamitous consequences detailed in this affidavit,'' AngloGold said in court papers. "If urgent relief is not obtained, then AngloGold's most valuable mining asset in South Africa will be lost. The estimated value of destruction is R11.8 billion,'' said Bloomberg, citing the court papers.


    "DRD are planning to defend the application,'' James Duncan, a spokesman for the company told Bloomberg. "DRD's position is that charges of this sort cannot be delegated to the shareholder.''
